(UPDATE) Panel Sentences JBLM "Kill Team" Sergeant To Life In Prison

Staff Sgt. Calvin Gibbs will spend the rest of his life in jail.

A military panel sentenced Staff Sgt. Calvin R. Gibbs to life in prison with the possibility of parole, reduction in rank to the grade of E-1, loss of all pay and allowances, and a dishonorable discharge following his conviction of premeditated murder. 

Earlier today in the General Court-Martial case of U.S. vs. Staff Sgt. Calvin R. Gibbs, the same military panel found the accused guilty of all specifications and charges referred against him.

Charges against Staff Sgt. Gibbs were referred to a general court-martial after the Commanding General reviewed the charges and evidence against Gibbs, the Article 32 Investigating Officer’s Report, the recommendation of the Special Court-Martial Convening Authority, and the recommendation of the Staff Judge Advocate.

- Three specifications of premeditated murder under Uniform Code of Military Justice, Article 118

-  One specification of unlawfully striking another Soldier, and one specification of committing an assault with a dangerous weapon, UCMJ Article 128

-  One specification of conspiracy to commit premeditated murder, one specification of conspiracy to commit assault consummated by battery, and one specification of conspiracy to commit aggravated assault with a dangerous weapon, UCMJ Article 81

-  Two specifications of conduct prejudicial to good order and discipline, two specification of wrongfully endeavoring to impede an investigation, UCMJ Article 134. One specification of wrongfully communicating a threat to injure, UCMJ Article 134, was dismissed earlier in the court proceedings.

-  Two specifications of dereliction of duty, and one specification of violating a lawful general order, UCMJ Article 92

U.S. Army Corrections Command will determine the location of confinement for Gibbs.

In the General Court-Martial case of U.S. vs. Staff Sgt. Calvin R. Gibbs, the accused was found guilty of all specifications and charges by a military panel.

The court immediately proceeded into the sentencing phase. The panel will determine if Gibbs will face life in prison with or without the possibility of parole.
